TachoPomoc App Terms of Use
1. General provisions
These terms set out the rules for using the TachoPomoc mobile app (the “App”). The service provider is Michał Sondej, running a sole proprietorship, Polish tax ID (NIP) 578-317-82-18, REGON 541736370, place of business: Elbląg (Poland); postal address available on request. Contact: [email protected] (personal data matters: [email protected] - see the Privacy Policy). By installing or using the App you accept these terms.
2. What the App is
The App contains educational material on operating digital tachographs: step-by-step instructions, a message dictionary, an SOS guide, an overview of the rules on driving time and of requirements in individual countries. This content works offline and does not require an account. The App also contains the “Working time assistant” module - a helper tool for tracking driving limits, breaks and rest periods under Regulation (EC) No 561/2006 and Directive 2002/15/EC, with a local activity log and on-device notifications. The module does not replace the tachograph or the driver card - the only legally binding source of data during an inspection is the tachograph record. In addition, the App contains an industry news section with news downloaded from our website tachopomoc.pl - an internet connection is required for it to work.
The “SOS” section is purely informational - it suggests what to do in typical situations (e.g. an inspection, a gap in the records). It does not call for help, does not use location, and does not use contacts or calls.
The App (interface and substantive content: instructions, rules, message dictionary, countries) is available in Polish, Ukrainian and English. The language can be chosen in the App settings at any time without reinstalling.
3. Free and paid scope
- Free modules: Rules and breaks, Working time assistant, SOS, Message dictionary, Countries, “Rate the app”, as well as selected scenarios and a preview of the first steps of every scenario.
- Paid unlock is a one-time in-app purchase (“full access”) that unlocks all scenarios and instruction steps, the “Truck driving bans” module and the driver card file (.ddd) import with history and infringement analysis, including features added in future updates. It is not a subscription - there are no recurring charges.
4. Purchases and payments
Purchases are made through Google Play (Google Play Billing); entitlements are handled by the RevenueCat service. The gross price is shown in the App and in Google Play before you confirm the purchase. The purchase is linked to the Google account used in Google Play - after changing devices you can restore access with the “Restore purchases” function.
5. Withdrawal and refunds
Full access is digital content supplied immediately after purchase. By confirming the purchase you consent to immediate supply of the content and acknowledge that you thereby lose the statutory right of withdrawal (Art. 38(13) of the Polish Consumer Rights Act, implementing Art. 16(m) of Directive 2011/83/EU). Regardless of this, you can use the Google Play refund policy: support.google.com/googleplay/answer/2479637. In justified cases we will also consider a refund after contact by e-mail.
6. Licence
The App and its content (texts, graphics, display visualisations) are protected by copyright. You receive a non-exclusive, non-transferable licence to use the App on your own devices, for personal use or as part of your own professional work. Copying, reselling and publicly sharing the App's content is prohibited.
7. Informational nature of the content
The substantive content is based on applicable law: Regulation (EC) No 561/2006 (driving time, breaks, rest periods), Directive 2002/15/EC (drivers' working time), Regulation (EU) No 165/2014 (tachographs) and Polish acts on road transport and on drivers' working time. Operating instructions for individual tachograph models are based on the official documentation of their manufacturers (Continental/VDO, Stoneridge). Some content - including the “Drivers' questions” section - is also based on questions that drivers actually ask (e.g. in public discussion groups); in every such case the answer is based on the legislation listed above, not on the opinions of other internet users. Where the rules do not settle a situation unambiguously, we try to say so explicitly.
The App's content is educational and supportive. It is not legal advice or the tachograph manufacturer's official manual. Despite our efforts to be accurate, it may contain inaccuracies or errors - e.g. resulting from changes in device software, differences between model variants, or changes in the law and enforcement practice after the date of the last App update. In case of doubt, follow the current law, the official device manual and the instructions of enforcement officers. The service provider strives to keep the content accurate and up to date, but is not liable for the consequences of decisions made solely on the basis of the App, to the extent permitted by law. Nothing in these terms excludes liability that cannot be excluded towards consumers under the law.
Content available in Ukrainian and English translation is supportive and was prepared with the help of artificial intelligence (AI). In case of doubt or discrepancy between the Polish version and a translation, and in every case requiring legal certainty, the Polish version and the current wording of the relevant legislation (including Regulation (EC) No 561/2006) prevail.
The “Working time assistant” module bases its counters on entries added manually by the User or imported from a driver card file and on a simplified interpretation of the rules on driving and working time - in practice it is not always possible to reproduce every case unambiguously (e.g. the exact 4-month reference period for average working time is calculated from the data actually available locally on the device). The module is indicative and supportive - it does not replace the tachograph, the driver card or your own analysis of compliance with the rules, and the only legally binding source of data during an inspection remains the tachograph record.
The “Countries” module describes selected requirements for international transport in an illustrative and abridged way. The rules of individual countries may change independently of App updates - before travelling, check the current requirements of the destination country with the competent authorities or in official sources.
News in the industry news section comes from external sources (e.g. industry portals) and is only aggregated by the App; the summaries are prepared automatically using artificial intelligence (AI) based on the source content. The service provider is not the author of this content, does not verify it on an ongoing basis and is not liable for its accuracy, completeness or timeliness, to the extent permitted by law - every news item links to the original article at the source, which remains binding.
8. Technical requirements and availability
The App requires a device running a version of Android supported by Google Play. An internet connection is needed only to make and restore a purchase - the content works offline. The industry news section requires an internet connection throughout its use.
Purchasing, restoring purchases, the industry news section and the tachopomoc.pl website depend on the availability of external services (including Google Play, RevenueCat, the hosting provider). The service provider does not guarantee uninterrupted and error-free operation of these services or of the App itself and is not liable for interruptions or errors on their side or due to causes beyond its control (e.g. network failures, force majeure), to the extent permitted by law.
9. Limitation of liability
The App is provided “as is”, without additional warranties beyond those arising directly from the law. To the extent permitted by law, the service provider's liability towards the User is limited to the amount actually paid for full access and does not cover lost profits or indirect damage. This limitation does not apply to damage caused intentionally or to liability that cannot be excluded or limited towards consumers under the law (including liability for the conformity of digital content with the contract).
If any provision of these terms proves invalid or ineffective, the remaining provisions remain in force, and the invalid provision is replaced by a rule as close as possible to its purpose.
10. Complaints
You can submit complaints about the App or a purchase to [email protected]. We will reply within 14 days. Complaints about the payment itself can also be sent directly to Google Play.

12. Changes to the terms
These terms may be amended, e.g. when the scope of features or the law changes. The current version is always available at this address, and we will announce material changes in the App update notes. Changes do not limit rights already acquired - purchased full access remains valid.
13. Governing law
These terms are governed by Polish law. If you are a consumer habitually resident in another country, the choice of Polish law does not deprive you of the protection afforded to you by the mandatory provisions of the law of that country. You can bring consumer disputes before the competent court or use out-of-court dispute resolution (e.g. consumer ombudsmen, the Trade Inspection and, in other EU countries, the national European Consumer Centres - ECC).
